RAPIDES PARISH, La. (KALB) - The attorney for Kayla Giles, the woman accused of shooting and killing her estranged husband, Thomas Coutee, Jr. in September in the parking lot of Walmart on Coliseum Boulevard, is asking a newly assigned judge to reconsider motions previously ruled on by Judge Mary Doggett.
Judge Doggett recused herself from the case last month due to the fact that her nephew by marriage represented Coutee, Jr. in his divorce proceedings.
Paul Carmouche wants Judge Greg Beard, who is now assigned to the case, to reset motions for a bill of particulars, preliminary examination, bond reduction, and to quash the indictment. Judge Doggett had previously ruled on those motions, and effectively denied them.
"In order to avoid even the appearance of impropriety in these proceedings, it is imperative that the previous motions filed on behalf of the Defendant be reheard before a fair and impartial judge," the motion states.
The motion to attempt to reset the previous motions is set to be heard on February 19, which is the next court appearance for Kayla Giles.
