New Orleans abortion provider must pay La. fine

BATON ROUGE, La. (AP) - A New Orleans outpatient abortion clinic must pay a $1,200 fine levied by the state for being out of compliance with state rules and regulations on abortion clinics, according to the Louisiana Supreme Court.
    
The state 1st Circuit Court of Appeal in December threw out $1,200 in civil fines that the Department of Health and Hospitals levied against Midtown Medical LLC, saying DHH didn't have the legal authority to impose the penalties.
    
The appellate court determined outpatient abortion providers aren't listed in state statutes as facilities that DHH can sanction.
    
The Supreme Court disagreed Friday, reinstating state District Judge Wilson Fields' 2012 decision to side with DHH.
    
The fine was levied in 2010. An attorney representing Midtown Medical had no comment.
