Accused child predator to receive mental evaluation

MONROE, La. (KNOE 8 News) - KNOE 8 News has learned that the attorney for Christopher Nixon has filed a Request for Competency Evaluation.

Nixon was arrested after allegedly posting a child pornography video that was discovered in Canada.

The suspect was arrested in December at a residence near Jonesboro, LA after HSI received nearly 50 tips from the public via the HSI Tip Line.

Nixon's lawyer, Adam Huddleston, filed a motion on February 21, 2014, just three days after he was denied bond in a detention hearing.

Huddleston told KNOE 8 News that the request was granted on February 24, 2014.  The request was filed by Huddleston.

Nixon will be turned over to the U.S. Attorney General's office and will be sent to a mental health facility to face a psychiatric evaluation.  The evaluation will seek to determine two things.

First, the evaluation will seek to see if that Nixon was competent at the time of the alleged events.  In essence, the examination will determine if Nixon knew the difference between right and wrong at the time of the alleged incidents. Secondly, the evaluation will seek to see if Nixon is competent to stand trial.

Huddleston says that the examination has not taken place, and that he was unsure when it would take place.  Because of that no other hearings have been scheduled at this time. Huddleston also told KNOE 8 News that the evaluation results could lead to a change of plea.

Chris Nixon was denied bond in his production of child pornography case on February 18, 2013.

Nixon, who had previously waived his right to a detention hearing, asked a judge for home based detention. In the hearing, defense attorney Adam Huddleston, asked the judge to allow for Nixon to be released to his life partner.

The judge denied the request over concerns about the environment that Nixon would be released to.

Prosecutors also argued that Nixon was a flight risk. Nixon would remains behind bars until his trial.
