NEW ORLEANS (KNOE 8 News/AP) - A witness has testified that a former New Orleans police officer shot and killed a man while he was running away.

Now-retired Officer Linda Howard was on duty with Officer David Warren when he shot Henry Glover, just days after Hurricane Katrina.

Howard testified that Warren fired as Glover and his brother-in-law Bernard Calloway ran in different directions.

In earlier testimony Wednesday, Calloway told a federal district court jury that Glover was merely lighting a cigarette when he was shot.

Jurors must sift through such conflicting accounts to decide whether Warren acted reasonably when he shot the 31-year-old Glover. He's charged with violating Glover's civil rights and using a weapon in a violent crime.

Calloway was the trial's first witness. Howard wound up the first day of testimony.

Trial resumes Thursday.
