Defense attorney files motions in Dalton Fletcher case

MONROE, La. (KNOE 8 News) - New motions are being filed in the Dalton Fletcher sentencing phase. He's convicted in the shooting deaths of his parents, Johnny and Tammy Fletcher. This all happened in West Ouachita back in September 2010.

Defense Attorney Charles Kincade says he's hoping a jury will make the final decision in sentencing, rather than having a judge do the job. United Sates law says juveniles convicted of murder, cannot be given a life sentence without the possibility of parole.

"The law in which the state has now implemented, and enacted regarding the procedure for making that determination, we're alleging that this is unconstitutional and so we filed those motions recently in court," Kincade said.

The attorney is hoping his client will be granted parole. Fletcher pleaded not guilty by reason of insanity. His trial was held in Benton, Louisiana.

Re-sentencing is scheduled for October 10 and 11.
