Christmases sue over 84 alligators

JACKSON, Miss. (AP) - Tom Christmas and his wife argue they didn't discover the 84-plus alligators on land next to their homestead until four years after they bought the property in southwest Mississippi.

Exxon Mobil Corporation said the Christmases real estate agent told them about alligators in the area as far back as 2003.

Exxon said with the clock ticking on the three-year statute of limitations, the couple waited too long to file a lawsuit claiming a bunch of alligators robbed them of enjoyment of their land.

On Tuesday, the state Court of Appeals ordered a Wilkinson County judge to sort the whole thing out.

The Christmases sued Exxon in 2008. Circuit Judge Lillie Sanders threw out the suit in 2011.

The Christmases wanted a jury to determine if the alligators were a nuisance.
