Husband who buried wife in yard, must dig her up

ALABAMA (KNOE 8 News / AP) - An Alabama man who buried his wife in his front yard will have to dig her up.

The state court of civil appeals upheld a lower court's ruling Friday that she couldn't be buried along a main road.

Authorities say James Davis will have to move the remains to an approved cemetery. Davis buried his wife, Patsy, in their front yard after she died in 2009.

Davis says it was his wife's dying wish. Davis said he asked the city council for permission. They denied the request. But, he did it anyway. Davis says the law is on his side because there are no ordinances regulating cemeteries.
