Mississippi man to be allowed to appeal his plea

JACKSON, Miss. (AP) - The state Court of Appeals will allow a Picayune man to appeal his guilty plea to being under the influence of drugs when he caused a 2008, collision that claimed the life of a 13-year-old girl and left two others seriously injured.

Brian Mooney pleaded guilty in 2011 to driving under the influence and DUI causing serious injuries. He was sentenced to 20 years on each charge to run concurrently.

Authorities say Mooney was under the influence of cocaine and the prescription muscle relaxer Soma when his SUV crashed head-on with a car, killing Lashae Necaise and injuring two others.

While there was some question about the timeliness of Mooney's appeal, the Appeals Court ruled this week Mooney could file an appeal.
