Michael Davis enters Diversion Program

Posted: Updated:

MONROE, La. (KNOE 8 News) - Charges against former Ouachita Sheriff's Major Michael Karl Davis are being dropped.

Conspiracy, fraud, identity theft, and obstruction are all charges Michael Davis was indicted with in fall of 2011. After numerous meetings with U.S. Attorneys and delays in the court room, a decision has finally been reached.

"We have been defending the case the entire time, and we've been discussing the case with the U.S. attorney, and to arrive at this agreement of diversion, required both parties to agree to it," says Davis' attorney Charles Kincade.

Diversion is an agreement that Kincade has never been involved with in his 20 years of law.

"Diversion in the federal system is very unusual, it's rare, but in this case it was entirely appropriate," Kincade says, "he's not pleading guilty to anything, felony or misdemeanor, and in due course, every single charge against him will be dismissed."

Davis will be monitored by the U.S. probation office for at least one year, then all charges be dropped. This is an exciting announcement for Davis, especially after watching his former boss and Ouachita Parish Sheriff Royce Toney pleaded guilty to 9 misdemeanors last month. Kincade says Davis just wishes he could have the last year of his life back.
