MONROE, La. (KNOE 8 News) - Ouachita Sheriff Major Michael Karl Savis is ready to break ties with his accused partner in crime - Sheriff Royce Toney. Both Toney and Davis are charged with conspiracy, computer fraud, identity theft and obstruction. But Davis' attorney Charles Kincade said Davis wants the trial split.
"There are some separate charges that Toney is charged with that Davis is not," said Kincade.
A federal judge already denied Davis' request to have a separate trial in April. Davis didn't think he would be tried fairly with Toney because of Toney's status in the community.
"We think that candidly Sheriff Toney brings a lot of baggage to the trial which Mr. Davis does not," said Davis. "And we just feel it would be most fair if it was separated where the jury would have no confusion or be able to separate the evidence among the defendants."
Recently Toney made a request for a later trial so he can have more time to settle disputes and pending pretrial motions. Davis is against it.
"We don't want the trial postponed, Sheriff Toney does," said Davis. "We think the logical solution would be to separate the trials. "
But that's all up to the judge. As of now, both men are due in court on July 17th.
