Appeal filed in Federal Court attacks Concordia D.A.

CONCORDIA PARISH, La., (KNOE 8 News) - An appeal filed in federal court this week is seeking sanctions against Concordia District Attorney, Brad Burget.

A new trial for Jim Whittington on a ruling setting aside the jury's April 25 verdict in Alexandria is being sought in the federal civil suit against Sheriff Randy Maxwell. A jury found for Maxwell and against Whittington on claims Maxwell maliciously prosecuted Whittington in 2004. 

In his petition for a new trial, Whittington's attorney alleges that "Burget's testimony was suborned and modified solely to benefit Maxwell and to contraindicate the testimony of Ronnie McMillen. Had Burget testified truthfully, such would have only enhanced the testimony of McMillen and cast aspersions to the defendant's (Maxwell) credibility."

The appeal document seeks a hearing before Federal Judge Dee Drell as to possible sanctions against Burget on the allegation of perjury.
